Welcome to WaypointCommons ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our services provided for yacht charters and our online platform at waypointcommons.site (the "Service"), which is managed by WaypointCommons.

If you choose to make a reservation or utilize our Service, you consent to comply with these Terms. Should you not agree with any of these terms, you must refrain from accessing the Service.

2. Service Overview

At WaypointCommons, we offer an array of exclusive yacht charter services, which include but are not limited to:

  • Day-long yacht hires
  • Evening yacht cruises
  • Business retreats
  • Exclusive gatherings
  • Extended yacht charters

We provide services based on their availability and prevailing weather conditions. The availability of services may change, and we hold the right to alter or cancel services anytime.

3. Booking and Reservations

3.1 Booking Process

For charter reservation, the following requirements must be met:

  • Attainment of the minimum age of 18 years
  • Submission of complete and accurate details
  • Remittance of a stipulated deposit as outlined in the booking confirmation
  • Acceptance of these Terms & Conditions

3.2 Confirmation

A reservation is only deemed confirmed after the payment is processed and you receive our written confirmation. We retain the discretionary right to decline service provision to any person.

3.3 Availability

Charter reservations are contingent on vessel availability and conducive weather conditions. We strive to accommodate your requested dates and times whenever feasible.

4. Payment Terms

4.1 Pricing

All listed prices are in € and are inclusive of any applicable taxes, unless otherwise specified. Pricing is subject to change without prior notification.

4.2 Payment Schedule

  • Initial deposit: 50% of the overall charter fee, payable at time of booking
  • Remaining balance: Payable 48 hours prior to the charter commencement
  • Incidental charges (if applicable): Payable upon conclusion of the charter

4.3 Payment Methods

Payments can be made via major credit cards, bank wire transfers, and certified bank drafts. We use secure, encrypted procedures for processing payments.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

  • With over 72 hours notice before departure: Entire refund excluding any processing fees
  • From 24 to 72 hours before departure: 50% of the payment refunded
  • Under 24 hours notice before departure: No entitlement to a refund

5.2 Weather Cancellations

In case our captain concludes weather conditions to be unsafe, we will propose either:

  • Rescheduling your charter to another suitable date at no extra cost
  • A full refund in the event that rescheduling is unfeasible

5.3 Mechanical Issues

If there's a mechanical malfunction with the assigned vessel, we will endeavor to arrange a comparable vessel. If that's not feasible, we will issue a complete refund.

6. Safety and Conduct

6.1 Safety Requirements

All guests are required to:

  • Heed all directives from the crew
  • Utilize the safety gear as instructed
  • Inform of any health conditions that could affect their security
  • Stay within the designated areas on the craft

6.2 Prohibited Items

The following articles are not allowed aboard:

  • Containers made of glass
  • Illicit substances
  • Firearms or other weapons
  • Non-alcoholic beverages in excess (to the extent of reasonable consumption)
  • Pets, except with prior approval

6.3 Conduct

Passengers should behave respectfully at all times. Charters could be terminated without reimbursement if a guest's actions pose a safety threat or if they spoil the experience for others.

7. Liability and Insurance

7.1 Our Liability

We limit our liability to the charter fee paid. Our company won't be accountable for:

  • Injuries suffered due to passenger negligence
  • The loss or destruction of personal belongings
  • Indirect, consequential, or exemplary damages
  • Delays due to weather conditions or external factors beyond our control

7.2 Insurance Coverage

We have extensive marine insurance that covers our fleet and operations. It is recommended for passengers to have their own travel and personal insurance policies.

7.3 Assumption of Risk

Participation in our yachting services signifies acknowledgment of the inherent risks associated with maritime activities and an agreement to personally assume them.

8. Modifications and Itinerary Changes

We reserve the authority to adjust travel plans, pathways, or timeframes based on climatic, safety, or operational needs. We will try to ensure comparable alternatives are provided.

9. Force Majeure

We will not be held responsible for alterations or delays brought about by uncontrollable factors, including:

  • Extremely adverse weather conditions
  • Natural disasters
  • Government-issued directives
  • Shut-down of ports
  • Mechanical breakdowns

10. Privacy and Data Protection

Your personal data is processed according to our Privacy Policy. By engaging our services, you consent to the collection and usage of your information as summarized in the Privacy Policy.

11. Intellectual Property

All assets available on our website, such as texts, visuals, logos, and imagery are protected by copyright and trademark statutes. Unauthorized reproduction, distribution, or the creation of derivative works is not permitted without our explicit consent.
